Kibor's widow seeks court help after alleged eviction from matrimonial home

She claims Kibor’s other sons and daughters have ganged up to frustrate her

The fourth and youngest widow of former prominent Eldoret farmer and politician Jackson Kibor has moved to the High Court seeking protection.

Eunita Kibor alleges that she has been evicted from her matrimonial home along with her four children and they are now facing threats of being evicted from the 300-acre Mafuta farm given to her by Kibor before his death.

In an application filed under a certificate of urgency, Eunita and her children claim Kibor’s other sons and daughters have ganged up to frustrate her and ensure she loses all her inheritance.

She alleges that her step-children have acted in breach of an active court order restraining any of the beneficiaries from inter-meddling with the estate.

However, all the accused have filed their responses and they accuse Eunita of interfering with the estate and disobeying court orders.

Kibor left behind a vast estate valued at more than Sh16 billion, which is at the centre of a vicious succession battle involving his widows and children.

The estate includes more than 6,000 acres in Uasin Gishu.

Eunita has accused her step-children of contempt of court by interfering with three parcels of land in the estate.

She has also accused her step-children of cruelty and abuse, claiming that three months after Mzee Kibor’s burial, her step-children unlawfully evicted her and her children from her Kabenes matrimonial home.

“After Kibor’s death, my children have had their fundamental rights and freedom grossly violated, infringed and threatened,” Eunita argues in the court papers seen by the Star.

Kibor died on March 17, 2022, leaving behind three widows and 29 children.

Eunita and her children appeared before High Court judge Reuben Nyakundi, who is hearing the family succession dispute.

She says her eldest son had been forced to temporarily suspend his studies abroad and return to the country fearing his family would be harmed.

Justice Nyakundi sought to know the whereabouts of Eunita's eldest son, who was asked to stand in court proving he had returned home from abroad.

Eunita, 45, says they have suffered acts of violence, torture, abuse, cruel, inhuman or degrading treatment at the hands of the respondents on their own or through individuals acting on their behalf.

She also accuses the respondents of threatening her and freezing bank accounts that held funds meant for taking care of her children, making it difficult for her to provide their basic needs.

Eunita is represented by Kalya and Company advocates.

She argues that Kibor catered to her and the four children with proceeds generated from his rental units in Eldoret and from farming activities in Mafuta farm, measuring 143 hectares (353 acres) and from other farms measuring an estimated 1,600 acres in Kabenes.

Eunita wants the court to review its preservation orders issued in November 2022 to specify the land each household occupies, saying doing so will protect her and her children.

She also wants the eight respondents and any extended family member restrained from trespassing or interfering with the properties she occupies and from collecting rent from the rental units left behind by Kibor.

Justice Nyakundi extended orders preserving the estate from any interference until the succession dispute is heard and determined.

He directed that Eunita’s application be heard on May 20, 2024.
